Judge reported for misconduct – minor remained in custody

Two judges at a district court in the Stockholm area are being reported to the State's disciplinary board. This is after they allowed a minor to be detained in custody for more than three months without any detention hearing, reports Dagens Juridik.

The minor, detained on March 8, was re-detained on several occasions despite the three-month deadline being exceeded without any detention hearing being held. The defense attorney agreed to continued detention.

On June 12, the prosecutor brought charges. About a week later, the judge responsible for the deadlines at the department discovered that her colleagues had not held a detention hearing. She then decided to revoke the detention.

According to the State's disciplinary board, the failure to hold a detention hearing has meant that the detainee was "deprived of a central and explicitly stated procedural right."

The two judges are suspected of having committed official misconduct, according to the board.

The judge responsible for the deadlines, who notified her colleagues that they had missed the hearing, is not being reported.
