"No to Spotify – night shifts not exempted"

Spotify was denied exemption for night work by the Administrative Court. Now the Court of Appeal also says no, according to a press release.

"The Court of Appeal assesses that Spotify AB's need for night work does not imply that there are such special reasons required to grant an exemption from the ban on night work", they write in their assessment.

Spotify, which lacks a collective agreement, has applied for exemption for 250 employees, among other things, as they want to "maintain the operation of the company's services and protect the large amount of personal data that the company has".

In addition to the Administrative Court, the Work Environment Authority has also recently said no to night work.

"Since the main business that Spotify AB conducts is audio streaming, primarily of music, the Court of Appeal believes that the work on disruptions weighs less heavily in the assessment of whether there are special reasons for exemption", says Court of Appeal Judge Daniel Sjölund, in the press release.
