The Migration Agency denied 1,278 foreign nationals residence and work permits to pick berries in Sweden during the summer and autumn. Now the Migration Court is overturning the decision.

In its decision, the Migration Agency argued that the berry pickers could not be guaranteed sufficiently good working conditions – in the form of working hours and remuneration – from the employers.

The decision regarding the denied permits was appealed and now the court is assessing that there is not sufficient support for the Migration Agency's stance.

"The court believes that it has been made probable by the appeal that employees will be given good working conditions regarding, among other things, working hours and salary", says Judge Mats Dahlström in a press release.

The Migration Court has sent the case back to the Migration Agency for further processing and a new decision.
